Many crop breeders allow farmer to farmer seed sales of certain crop varieties, provided the Variety License conditions are met and the trade is correctly recorded and lodged with the relevant plant breeder.
When trading grain between growers, the PBR Act still governs the transaction and compliance with EPR payment is required.
While each breeder has slightly different requirements, the following common steps generally apply.
- Check whether direct farmer to farmer sales are permitted for that specific variety. This is available within the Variety and Rates information tables in the “Grower to Grower Sales Permitted” column.
- If direct trade of a variety is permitted, note who the breeder is of the variety and reach out as per below for information about their process and requirements, to ensure the sale is recorded correctly and the breeder is informed of the transfer.
